Agreement to Terms
By accessing or using PresenceKit's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Services
PresenceKit provides digital marketing services including website design, search engine optimization, content creation, and related services as described in our service packages.
Service Packages
Our services are provided through monthly subscription packages:
- Essentials: $750/month
- Get Found: $1,500/month
- Stand Out: $3,000/month
Specific deliverables and service levels are outlined in your service agreement.
Payment Terms
- Payment is due at the beginning of each billing cycle
- Setup fees (if applicable) are due before work begins
- We accept major credit cards and ACH transfers
- Late payments may result in service suspension
Initial Commitment & Cancellation
- Services require a 3-month initial commitment
- After the initial period, services are month-to-month
- Cancellation requires 30 days written notice
- No refunds for partial months
Client Responsibilities
You agree to:
- Provide accurate and complete information
- Provide necessary brand assets and content in a timely manner
- Review and approve deliverables within reasonable timeframes
- Maintain accurate contact information
- Comply with all applicable laws and regulations
Intellectual Property
Your Content
You retain ownership of all content, logos, and materials you provide to us. You grant us a license to use these materials to provide our services.
Our Work
Upon full payment, you own the deliverables we create for you, including website designs, content, and graphics. We retain the right to showcase work in our portfolio.
Limitation of Liability
PresenceKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.
No Guarantees
While we strive for excellent results, we cannot guarantee specific rankings, traffic levels, or business outcomes. Digital marketing results vary based on many factors outside our control.
Confidentiality
We will keep your business information confidential and will not share it with third parties except as necessary to provide our services or as required by law.
Termination
Either party may terminate services with 30 days written notice after the initial commitment period. We may terminate immediately for breach of these terms or non-payment.
Modifications
We reserve the right to modify these terms at any time. We will provide notice of material changes. Continued use of our services constitutes acceptance of modified terms.
Governing Law
These terms shall be governed by the laws of the State of Washington, without regard to conflict of law principles.
